Absence & RTW

Absences are a common occurrence in all companies.  Dependant on the severity of the absence there may be a need to have specific accident/incident information filed in a separate medical personnel file for future STD/LTD/WSIB requirements.

Under the Personal Health Information Privacy Act (PHIPA) and Privacy Protection Act (PIPEDA), such medical information remains confidential and may not be released unless specifically consented to by the injured worker.

It is important to note that those on the JHSC or in Senior Management positions who are made aware of such information by virtue of their position(s) at the time of the Accident/Injury Investigation are required to keep all personal worker information confidential at all times.
